Terms & Conditions

These Terms & Conditions (“Terms”) govern the services provided by Techesprit (“we,” “our,” or “us”) to clients (“Client,” “you,” or “your”). By engaging Techesprit for WordPress development, website services, or SEO services, you agree to these Terms. If you do not agree with these Terms, please do not use our services.

Services Provided

TechEsprit provides WordPress development and SEO services, which may include:

  • Custom WordPress website development and redesigns.
  • WordPress theme and plugin development or customization.
  • Website maintenance, updates, and technical support.
  • Website speed and performance optimization.
  • Technical SEO and on-page SEO.
    Keyword research and SEO strategy.
  • Content optimization and internal linking.
  • SEO monitoring, reporting, and ongoing optimization.
  • The exact services, deliverables, timelines, and fees will depend on the individual project or service agreement.

 

We aim to deliver professional, reliable, and practical solutions. However, SEO performance and other website outcomes can be affected by factors outside our control, including search-engine algorithm changes, competition, hosting issues, third-party services, and changes made by the Client.

Client Responsibilities

To keep projects moving smoothly, the Client agrees to:

  • Provide accurate business information, website content, images, branding assets, and other materials required for the project.
  • Provide timely feedback, approvals, and access to relevant accounts.
  • Provide access to the WordPress website, hosting, domain, Google Search Console, Google Analytics, or other platforms where required.
  • Ensure that all content, images, trademarks, and other materials supplied to TechEsprit are legally permitted for use.
  • Maintain active hosting, domain, and third-party accounts where these are the Client’s responsibility.
  • Notify TechEsprit of any changes made to the website or SEO setup that may affect ongoing work.

Delays in providing information, access, or approvals may result in changes to the agreed project timeline.

Intellectual Property Rights

  • Ownership of Work: All websites, code, designs, campaigns, strategies, templates, and other creative or technical deliverables developed by Techesprit remain the sole intellectual property of Techesprit unless explicitly stated otherwise in a written agreement.
  • Client License: Upon completion of services and subject to full payment of all agreed fees, Techesprit grants the Client a limited, non-exclusive, non-transferable license to use the deliverables for their business purposes.
  • Restrictions: Clients may not copy, resell, redistribute, or otherwise use Techesprit’s deliverables outside of the agreed project scope without prior written consent.
  • Right to Withdraw: Techesprit reserves the right to withhold, suspend, or remove deliverables, as well as cut off support, if:
    • The Client engages in intentional misuse of the deliverables,
    • The Client violates agreed payment terms (e.g., failure to pay outstanding amounts), or
    • The Client uses the deliverables for illegal, harmful, or unethical purposes.

This ensures that while Clients benefit from the use of our services, Techesprit retains ownership rights to its work and maintains the ability to protect its intellectual property.

Limitation of Liability

TechEsprit will make reasonable efforts to provide professional WordPress development and SEO services but cannot be responsible for issues caused by factors outside our reasonable control.

  • This includes, but is not limited to:
  • Search engine algorithm changes or penalties caused by factors outside our control.
  • Hosting or domain-provider outages.
  • Third-party plugin, theme, API, or software changes.
  • Security incidents resulting from compromised third-party systems or Client-controlled accounts.
  • Website changes made by the Client or another third party.
    Loss of rankings, traffic, leads, revenue, or other business outcomes.

To the maximum extent permitted by applicable law, TechEsprit will not be liable for indirect, incidental, or consequential losses arising from the use of our services.

Our total liability relating to a specific service will not exceed the amount paid by the Client for that service, except where otherwise required by law.

Governing Law & Jurisdiction

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of Pakistan.

If a dispute arises, both parties will first attempt to resolve it through good-faith discussion. Where appropriate, the parties may also attempt mediation before pursuing formal legal proceedings.

If the dispute cannot be resolved amicably, it will be subject to the applicable courts and jurisdiction of Pakistan.
